frank and grace. that's right. at this hour, we remain over the "fiscal cliff" at least technically. now, the senate did pass a bear bones bill to help us get by in the meantime and now, all eyes are on the house. >> mr. alexander. >> aye. >> reporter: in the early- morning hours of new years date senate began voting on a bill to avoid the so-called "fiscal cliff." >> the bill as amended is passed. >> reporter: the senate voted 89-8 to avoid tax hooks for 99% -- to avoid tax hikes for 99% of all americans. >> this shouldn't be the way we do things but i think we have done some good for the country. >> reporter: if the bill becomes law, the bush-era tax cuts will be permanently extended for everyone making less than $400,000 a year. and families making less than $450,000 a year. it will also keep the alternative minimum tax for the wealthy from hitting millions of middle class families.

>> middle class families will wake up today to the assurance that their taxes won't go up $2,200 each. >> reporter: the senate agreement delays a $110 billion in spending cuts that were due to kick in today for another two months. because the bill doesn't address spending, getting it passed in the house could be much tougher. >> the fact that the president won't challenge his party on spending cuts is disgusting. it's just disgusting. >> reporter: president obama wanted to dole with taxes and spending cuts at the same time. >> but with this congress, that was obviously a little too much to hope for at this time. >> reporter: house speaker john boehner has not yet publicly endorsed the deal. now, the house reconvenes at midday but lawmakers say, frank, they plan to study this bill hard before they take a vote. they say the senate has had months to get a bill passed and they are not going to rush to

get anything done. >> there is word, tara, that some republican lawmakers are upset about something the president said. could that effect support of the bill? >> reporter: it might. president obama chastised in his speech congress for taking too long to get the deal done. but he also threw something out at republicans saying if they think that spending cuts is the only thing that's going to reduce the deficit, they have another thing coming and that basically references the $16.5 trillion in debt which is the next issue on the table. a lot of republicans were offended and it could antagonize enough of them to jeopardize an "up" vote on this bill to get it done. >> they are making progress. that's a good sign in the new year. we see what the house says today. tara mergener live on this new

year's day in washington, thank you. and that's how they rang in 2013. about a million people in all over the world got the times square treatment. new york's crystal ball dropped into the new year. it was cold but worth it they say to join the party. looks like the weather cooperated for a spectacular night of fireworks along the waterfront in san francisco. they jammed the embarcadero as midnight approached. when it was all over the cars jammed the streets in the area. cbs 5 reporter cate caugiran is in san francisco where three revelers were wounded in shootings during the festivities. cate. >> reporter: good morning, grace. yes, police will be starting the new year looking for two suspects in two different

shootings that injured three people. the first one was at around 10:40 last night. a victim was taken to the hospital after being shot in the hand. the suspect was described as an adult male. the shooting took place near fisherman's wharf at jefferson and mason. less than an hour later a 12- year-old boy and man were shot near pier 23. the boy was hit in the foot and a man got a graze wound to the hip. police say all victims suffered nonlife-threatening injuries and so far no arrests have been made. aside from those two incidents, it was clear skies and bright lights for partiers. tens of thousands rang in the new year in a safe and festive way. >> 2012 was a good year. it was awesome. the giants got a world series again. i'm a huge giants fan. >> reporter: now, some of those people staked out their spots hours before. all of them gathered along the embarcadero to watch the 15- minute 5,000 fireworks and

effects show. the night went smoothly. san francisco police arrested 8 people for public intoxication and two for misdemeanor. live in of is, cate caugiran, cbs 5, live in san francisco. a suspect in a double murder in sacramento is now in police custody. gunfire ran out on second street in old sacramento last night. police say before the shooting, there was an argument and then a fight. a bar patron and employee were killed and three other people were wounded. we'll have a live report from sacramento coming up at 6:15. so what's open and what's closed on this new year's holiday? most federal, state, county and city offices are all shut down today including the post office. no mail today. banks are closed, as well. and in san francisco, if you are driving into the city today, you can leave your change at home because parking is free. that doesn't happen a lot. >> you always have to carry around a huge slew of quarters in the city. >> if you can find a spot. >> if you don't freeze to

the shoulder. chp is on the scene. slight spectator slowing but overall things are quiet on the guadalupe parkway. 280 no delays the rest of the south bay problem-free. live look at 880/237, still a six-minute ride westbound 237 between 880 and 101. an accident east 80 at the cordelia truck scales on the shoulder. one vehicle went down the embankment. a little bit of yellow on sensors. chp is on scene, no blockages, spectator slowing past the accident. westbound 4, 61 miles per hour. thank you. a major dismantling of some marijuana operations happening in remote areas of santa clara county. sheriff's deputies dropped from helicopters into eight locations and with help from state fish & game they cleared about 4 tons of material. that included some irrigation tubing, gardening equipment and a honda muffler that they

believe may have been used on a generator. the new year means fewer fire stations in contra costa county. supervisors voted unanimously last month to close the stations in clayton, lafayette, martinez and walnut creek. the move is expected to save that district about $8 million a year. there were no firefighter layoffs. they are expected to have longer response times in the fire direct. it is 6:09. a vigil is planned at noon in oakland today for a man who was shot and killed while detained by bart police. family will hold the vigil at the fruitvale bart station where oscar grant was shot four years ago today. officer johannes mehserle was later found guilty of involuntary manslaughter. he was released from jail in june of 2011 after serving has sentence. in other headlines, if you ride the bumper cars at the fair you do it at your own risk a ruling from the california supreme court.

imagine 40,000 people packing the streets here in old sacramento ready to have a new year's celebration. crime tape in old sacramento across the street where you see the white sign hanging off the overpass. two people died, three injured in the shooting. it happened at second street at the sports street cafe around 9:30 last night according to the sacramento police department. the police are now confirming and argument which turned know a fight happened inside the bar. during the fight a male suspect waved a gun fired several rounds toward the people he was fighting with. a 30-year-old female, 30-year- old man and an employee in his 20s were shot. the suspect still armed then ran right out into the middle of the street only to be caught by the police. the 22-year-old suspect is in custody at a local hospital

this morning. here's reaction from the streets on this the shiuing. >> at first when i heard the bullets everything was hiding. i went out to see the action and then i seen the officer jump off his horse. the horse kept going and the officer just did not have no fear. owe just took that guy down. >> reporter: the female victim has nonlife-threatening. the employee and patron died. the midnight fireworks was canceled. families down here, young children, down in the streets of old sacramento had to hear this. had to wait to see this chaos, hear this screaming. it makes you wonder, do you ever want to come back here for a new year's eve celebration? the mayor of sacramento former

nba star kevin johnson so sad by this news. why did this 22-year-old do this? >> thank you, sean bennett in old sacramento. secretary of state hillary clinton is expected to make a full recovery as she remains at a new york-presbyterian hospital where doctors hope some blood thinners will dissolve the clot in her head between her brain and skull. it's related to the concussion she had last month after the fall. doctors say she will be released from the hospital once the medication for the blood thinners has been established. and there is a sudden surge in marriages in maryland this new year's day. same-sex couples can now legally wed in the state. city halls in baltimore and some of the other bigger cities were open at midnight for couples who didn't want to wait any longer. maryland is the ninth u.s. state to legalize same-sex marriage. we have a number of new state laws that are going into

effect on this new year's day. the drivers here in california can text and email while driving if you use a voice- operated system. we have other laws restricting banks from pursuing those so- called dual track foreclosures. and there are also several measures designed to ensure the safety of natural gas pipelines. there's one hotly contested measure that's still on hold that is the ban on gay conversion therapy. it will not go into effect because of a federal appeals court ruling, issuing a stay. they are cleaning house. which oakland raiders were fired yesterday. >> and this could possibly be the best college touchdown of the year. you be the judge. it's our one-handed play of the day. >> i like it. ,,,,,,,,,,,,,,

tax cuts on annual incomes up to $400,000 for individuals and for couples making more than $450,000. and a one-year extension of jobless benefits for the long- term unemployed. there is also a two-month delay of across the board spending cuts that would have started hitting the pentagon and domestic agent sess agencies this week. >> we have done some good for the country. >> house speaker john boehner has not endorsed the deal yet so passage in the house is not a sure thing. we are joined on the phone now by congressman john garamendi a fairfield democrat who is going to be working today even though it's a holiday. >> got a long day ahead. thanks for joining us, congressman. happy new year to you. tell us, have you had a chance to look at the bill yet? what are the pros and cons ? >> happy new year to everybody in the bay area and hopefully it will be better than last year. i think it can be if we get our

work done here in. what. none of us has seen the language of the bill. we will get that this morning as we return to the capital and go through our caucuses around noontime here in washington, d.c. however, the essential elements are known and that is that the "fiscal cliff" at least half of it has been put off, the tax side. the cuts are yet to be dealt with. those will be coming up in the next two months. so while progress has been made there's still a lot of work to be done ahead of us. >> there's a lot of concern, congressman, about the markets and their reaction if you don't get a deal done by tomorrow when they reopen. do you have any idea if it's possible if the guys vote for today? >> i'm pretty sure this will pass. the senate passed with overwhelming margin. think there's over 90 votes in the senate for this legislation. it really puts extraordinary pressure on the house. i'm pretty sure this thing will pass. there's a lot to like in it and

a lot to dislike in it which means it's a compromise. the basic problem with it is it does not solve the overall deficit issue going forward. clearly, the revenues are in this bill. middle income tax pairs will not see their taxes go up, income taxes go up and a lot of the cuts that are in the sequestration are simply put off for two months. so we are going to have another showdown here in february and march. >> can you give us an idea what kind of feedback you got from constituents in northern california? and give us a little idea what the weekend was like in the chapel ber, how many hours. it must have been crazy in the chamber. >> well, the constituents in northern california want us to work together and get things done. and what happened in the last couple of days in the house was almost nothing. the action was over in the

senate between the senate and the white house. vice president biden and mcconnell ultimately worked out a deal. and the house is in a situation now where it's take it or leave it. we're going to be taking it. basically, we have been marking time for the last three or four days in the house as i think most people know, there was a total breakdown in the house of representatives before christmas. speaker boehner proposed his plan b. that did not get support in his own caucus and he simply sent us home for the christmas holiday. we came back on saturday and sunday and basically marked time taking up a few simple bills that were of little note with one exception. yesterday we did pass the intelligence bill which is very, very important to the united states but aside from that, it's been marking time waiting for the senate to do it. the senate did it late -- i guess early this morning and now the house will take it up around noontime here in

washington, d.c. i think it will pass. we'll go forward and with the new congress coming in on the 3rd of january, we'll begin once again to deal with the remaining problems, and they're out there. we do know that we have a deficit that's not yet been resolved. we do know that we have the sequestration on all those cuts that are simply waiting for us to deal with. and we have a debt limit and the funding of government. all of that is going to come together in february or early march. so it's likely to be a difficult spring here in washington. >> thank you, congressman for joining us live on washington, d.c. >> good luck. >> thank you. happy new year to california. >> happy new year. well, about a million people from all over the world got the times square treatment as new york's huge crystal ball dropped into the new year. a lot of kissing going on, too. one of the panels on the ball

contra costa county is operating with four fewer fire stations this morning. contra costa county board of supervisors voted to close stations in four towns. it will save them $8 million a year. they have 24 other fire stations and no firefighters were laid off. this morning, san jose mayor chuck reed is continuing a new year's day tradition. he is visiting police officers and firefighters who are all working on this holiday. right now, the mayor is attending a police briefing. then he will go to a half dozen fire stations around the city. a noontime vigil is planned in oakland today for a man who was shot and killed while detained by bart police. family members are hold the vigil at the fruitvale bart station where oscar grant was shot four years ago today. officer johannes mehserle was later found guilty of involuntary manslaughter. he was released from prison in

philadelphia. fireworks exploded over the delaware river... with the ben franklin bridg the backdrop. the city that's what new year's looked like in philadelphia. fireworks exploded over the delaware river with the ben franklin bridge as the backdrop. the city had two displays one at 6 p.m. geared toward family and then of course the one add mitt night. today's entertainment comes from a little football and a thing called the annual rose parade. >> cbs reporter louisa hodge is live in pasadena with fans out there. they are bringing in blankets and fire pits. looks like fun. >> reporter: the parade starts at 8:00 but 42 floats are lined up here. this is sort of the event

before the event if you will. check the crowds. thousands of people came out this morning at the crack of down just to take a look at all of these floats up close and personal. you can see the detail on some of these floats. the judges announced the winners. the coveted sweepstakes trophy went to dole with fiesta parade floats but a san francisco- based company or oakland-based company, i should say, kaiser permanente, that float also took a prize. and to tell us about that is bill caswell. now, tell us about this theme that you won? >> it's exciting. we have been part of the tournament for over eight-year and to get an award is a great honor. the theme depicts the fulfillment of all the aspects of the seuss theme.

patients of kaiser permanente with great stories and the colors and the flowers and the fruit and all the healthy things that we stand for. it's been a great year and it's a great tradition we have at the tournament. >> reporter: you have some of the doctors and nurses and employees doing good dance moves. >> there are dancers like the cat in the hat with the apparel and the white gloves and they will be dancing along with the float and i think it will be a delay to for everybody watching the parade. >> have you noticed any more san francisco-based floats that caught your eye? >> i'm a little biased but there's stanford university in the rose bowl today and they have a great float. it will be a great game this afternoon in the granddaddy of them all the rose bowl. >> reporter: what is it about just before the operate starts that so special? >> i think for kaiser permanente it is a culmination of almost a year of planning for the float and the parade. we have had over 500 employees decorate the floats all the way from maryland and ohio come together putting on the seeds and the berries and it's the spirit that we embracing throughout the year. >> reporter: thank you so much. that spirit is certainly going

[ laughter ] >> it was very mesmerizing! >> oh, my godness almost made me feel a little ill! oh, my goodness! partly cloudy skies out the door right now. if you are heading out it's chilly in the valleys. some of the temperatures are dropping down to freezing in the north bay. throughout the day skies are going to part. we'll see a lot of sunshine outside and really some nice weather although it's going to stay cool all day long. i think the next best chance of any rain will come over the weekend. we'll stay dry until then. and very cold in the early- morning hours. high pressure taking over as we set out the next couple of days. that means nice and dry conditions. and mostly sunny but those temperatures very cold in the early-morning hours. around the state 50s in the central valley 30s in lake

tahoe and partly cloudy skies. we are watching out for freezing temperatures tonight though. we are expecting a very cold night with clouds really clearing out and that means the temperatures will probably drop into the 20s in many spots in the north bay. still some computer models want to break up the clouds throughout the day today. mostly sunny in the afternoon. highs in the upper 40s to the 50s outside so cool especially into the east bay only about 50 degrees in concord. 51 in livermore. 56 warmer in santa rosa and 54 in san jose. looking out to this new year's we have some very nice weather dry weather just some passing clouds over the next couple of days. next best chance of rain and that's just a slight chance, will come on sunday. that's a look at weather. let's check traffic with gianna. >> thank you, lawrence. we'll do a bridge check right now. we are going to the bay bridge toll plaza. not a lot going on, traffic very light. we have reports of a stall though on the treasure island on-ramp to the upper deck of the bay bridge toll plaza. looks like though it's not accusing too much of a problem

today. over to the san mateo bridge, good-looking conditions both directions. no delays between 880 and 101. golden gate bridge same story clear along 101 as you work your way into san francisco. new reports of an accident though on 101 north 101 at moffett boulevard looks like a vehicle may have gone off the road there overturned off to the side. back to you. >> thank you. the new year's holiday means a day off for the stock traders on wall street. the dow gained 7% during 2012 a good year, that's more than the 5.5% in 2011. the nasdaq was up 16% in 2012 following 2% loss in 2011. so 2012 not bad. sales tax in california a little higher this morning than yesterday. the tax increased by one quarter of 1% as you may recall prop 30 passing boy the voters in november. the initiative, pushed by the governor, increased the sales tax rates 7.5%. that works out to about one-

cent for every four dollars spent. >> even if i it's a penny, five cents, it adds up because we shop a lot especially if you have young kids. i'm only 21 and i spend money like it's nothing. >> some local cities have even higher taxes around the bay area. taxes in el cerrito, union city are now at a whopping 9.5%. one of the biggest bans to come out of the bay area is ending its hiatus and the band is going back on the road, green day. the band halted its tour a few months ago after front man billie joe armstrong's bizarre behavior during a last vagus. he was treated for substance abuse. he posted a message thanking fans for their support. the tour begins in march in chicago. dates on the west cost have yet to be announced. lady gaga is planning to offer a therapist to her fans before concerts this in her next leg of her born this way

people during the celebrations on the embarcadero. most of them were for public intoxication. a suspect in a double murder in sacramento is now in police custody. gunfire rang out last night at a bar on second street in old sacramento. police say that before the shooting, there was some sort of argument and then a fight. a bar patron and an employee were killed. three other people were wounded. this incident forced the cancellation of the fireworks show in that area. on capitol hill, the house is expected to vote today on tomorrow on a bill to delay the "fiscal cliff." congressional members are set to reconvene in two hours. today, the senate passed that bill which deals with some issues like those income tax rates. it also calls for a two-month delay on the across-the-board cuts that were set to kick in tomorrow. i think lawrence discovered when you get in at 2 a.m. it's hard to do this show. >> it does get tiring after a while but i'm just so excited to be here with you guys on the
